1.2 General binding character of the conditions of use

The access to and use of the Website by you (“the User”) are submitted to the general conditions of use reflected here, inclusive of all attachments and modifications, if any, in the course of time. They are a binding agreement between you and the Manager (“the Agreement”).

You are kindly requested to carefully read these general conditions of use. Any further visit to or use of the Website implies automatically that you agree on these general conditions of use. If you do not agree on the provisions of these general conditions of use, we insist on you to no longer use the Website.

1.3 Subsequent adaptations of the conditions of use

You agree that the use of the Website and of the information therein is at your own risks. The Manager offers the Website in its “as is” state and offers no other guarantee in any form or capacity whatsoever.

The Manager cannot by any means be held responsible for any drawback a User might experience as a consequence of information found on the Website.

The information spread via banners, buttons, skyscrapers, flash, photographs or html pages or other means generated or supplied by third parties do not fall under the responsibility of the Manager.

3. RIGHTS AND DUTIES OF THE USER

3.1 Duties of the User

The User understands and agrees that the Website is meant solely for employers looking for candidate employees or candidate employees looking for an employer. This Site cannot be used for any other purpose.

As User you guarantee especially:

  1. that you are authorised according to the legislation in force in your country to visit this site and that you will comply with the rules applicable to you;

 

  1. that you will do your best to avoid that you would knowingly or unknowingly infringe the content of the Website or cause operational troubles or unavailability of the Website and that you will just as little provide your assistance to such practices;
  1. that you will not use the Website in a manner such as to infringe the rights of a legal entity or natural person and that you will not make unlawful use of the information available on the Website;

The Manager offers the Users of any kind a right of access to the Website for strictly internal and/or personal use for the search for a convenient worker or employer. This right is terminable and non-exclusive. A worker or employer cannot in any way commercialise or sell the data on the Website.

4. RIGHTS AND DUTIES OF THE MANAGER

4.1 Duties of the Manager

The Manager agrees to undertake all reasonable efforts in order to

  1. keep the Website up to date as fully and correctly as possible;
  2. keep the Website permanently available and fully operational;
  3. protect the Website against viruses or access to the supplied data by unauthorized people.

 

4.2 Rights of the Manager   

The Manager explicitly reserves the right to remove information posted on the site or hyperlinks to information at its entire discretion or to make them temporarily inaccessible when he obtains knowledge and is reasonable convinced of the unlawful character of such information.

4.3 Responsibility of the Manager

It is possible that the Website contains at a specific time, in spite of all efforts undertaken by the Manager, incomplete or wrong, not fully safe or temporarily unavailable information. The Website will also at specific moments be unavailable without prior notice for safety reasons, maintenance of the site or to remedy functional troubles. The Manager is in no case to be held responsible for the loss or damage incurred by a User on that account.

The Manager offers at no time a guarantee to the Users that the use of the Website will lead to finding an appropriate job or worker.

The Manager’s responsibility, whether for contract breach or in tort, is limited to an amount of EUR 500,00 as a maximum.

It is therefore not allowed to store, copy, reproduce, adapt, negotiate, publish the Website or any of its components without the Manager’s prior explicit consent in writing.

With regard to information you post on the Website, you give the Manager and other users a free non-exclusive and worldwide license of use for the purposes of the Website and the activities of the Manager.

5.3 As to the general conditions of use

The nullity of one or more provisions of these general conditions of use does not impair the validity, applicability and the binding character of the other provisions. The invalid provision will be replaced by a new one that will comply as closely as possible with the objective of the invalid provision.

5.4 Applicable law and competent courts

Belgian law governs these general conditions of use.

Only the Dutch-speaking courts of Brussels are competent to deal with any litigation relating to the application and interpretation of these conditions.
